Terms of Service

Legal · Effective October 2, 2026

The terms that apply to every order placed with Agera Legal Services, written in plain English. Please read them before you pay or send us documents.

The short version
  • Payment comes first. Work starts once the order is paid and we have everything we need.
  • No refunds once work has started. For process service, that means once the first attempt has been made. Each service below says when its work starts.
  • Fees are per address. A new or additional address is a new order. Attempts do not carry over from one address to another.
  • A non-service is a completed service. If the person does not live at the address you gave us, you get a sworn return of non-service. The fee is not refunded.
  • We are a process server, not a law firm. We cannot give legal advice.

1. General terms

These Terms of Service ("Terms") apply to every service provided by Agera Legal Services LLC ("Agera", "we", "us"), however the order is placed: through this website, the client portal, a payment link, email, text or phone. "You" means the person or company that places the order and pays for it.

By placing an order, paying, or sending us documents to serve, you agree to these Terms. If a written quote or agreement for a specific job says something different, the written quote or agreement controls for that job.

2. Orders and payment

  • Payment is due in full before work begins, unless we have agreed in writing to invoice you.
  • How to pay: by card, Apple Pay or Google Pay through our secure checkout (Stripe), or by Zelle to (786) 241-4146. Payment links expire after 24 hours; ask us and we will send a new one.
  • When work starts: when your payment has been received and we have complete documents and the information needed to do the job. Every timeframe on this site runs from that point.
  • Prices are the ones published on our website, or quoted to you, at the time you order. The price you paid is the price for that order, even if our prices later change.
  • Outside Miami-Dade County: jobs in other counties or states are quoted separately before you pay.
  • Extra charges (for example a second address, extra wait time or court costs) are only added after we tell you the amount and you agree to it.

3. Cancellations and refunds

  • Before work starts, you can cancel for a full refund, less any payment processing fees that our card processor does not return to us.
  • Once work has started, the order is non-refundable, in whole or in part. For process service, work has started once the first attempt has been made. For other services, see that service's section below.
  • This applies no matter what happens next: the case settles, the person is served by someone else, the papers are no longer needed, the person turns out to live somewhere else, or the court changes a date.
  • Refunds go back to the original payment method, normally within 10 business days.
  • Payment disputes: please contact us before you dispute a charge with your bank; most issues are resolved in a single call. If a charge for work already performed is disputed, we will provide the card issuer with our records of the work, including dates, times, GPS locations and photographs.

4. Services

These terms apply to each service in addition to sections 1 to 3.

4.1 Process service (standard, rush, same day and same day +)

  • Fees are per address. One order covers service at one address. Serving at a different or additional address is a new order, and attempts do not carry over from one address to another.
  • What is included: up to 4 attempts at that address at different times of day within your level's time, with a Saturday attempt when that time includes a Saturday; real-time status updates in your client portal; email confirmation; and a sworn affidavit or return of service, or of non-service. Every level includes the same.
  • Service times: Standard: first attempt within 72 hours, completed within 10 service days. Rush: first attempt within 24 hours (the next day), completed within 5 service days. Same day: first attempt on the day the order is received and paid, completed within 4 service days. Same day +: more than one attempt on that day, completed within 2 service days. Service days are Monday to Saturday, counted from when we have the paid order and the papers. Completed means served, or all included attempts made. A job can also be complete earlier, as the next points describe. First-attempt times also count from when we have the paid order and the papers, and attempts are made Monday to Saturday. These times are not guarantees that the person will be served.
  • If the person does not live at the address, has moved, cannot be identified there, or the address does not exist, the job is complete. You receive a return of non-service describing what we found, and the fee is not refunded. We are happy to take a new order for a new address.
  • After all included attempts without service, you receive a sworn return of non-service describing each attempt. More attempts, or a stakeout, can be added as wait time (section 4.6) with your approval.
  • How we serve: we serve only as Florida law allows (or the law of the state where the papers were issued). We decide the lawful method at the scene. We do not trespass, force entry, misrepresent who we are, or put anyone at risk. If a gated property refuses entry, or the server ends an attempt for safety reasons, the visit still counts as an attempt.
  • Affidavits and returns: delivered by email and through your client portal. If we made a mistake on an affidavit or return, we correct it at no charge. Changes needed because of information you gave us, or a re-issue in a different format after filing, may carry a fee that we tell you about first.
  • Outside Miami-Dade: service in other counties or states may be handled by a trusted process server in that area, at the price quoted to you before you pay.

4.2 Eviction notices

  • The fee (currently $85) is per notice, per unit or address.
  • We deliver or post the notice in the way Chapter 83, Florida Statutes, allows. You, as the landlord or agent, are responsible for what the notice says, the amounts and dates in it, and its legal sufficiency.
  • Work has started once we have attempted delivery or posted the notice. From then on the fee is non-refundable.

4.3 Court filing and court runs

  • The fee (currently $65) is per trip, per courthouse.
  • Filing fees, clerk and copy charges and certified copies are not included. You pay them. If we advance them on your behalf, you reimburse them before the documents are released.
  • We are not responsible for a filing the clerk rejects because of the documents' content, form or missing items.
  • Work has started once the trip has been made.

4.4 Notary public

  • Notary fees are charged per notarial act (currently $10, the Florida maximum), plus a travel fee of $5 per mile.
  • Every signer must be present, show valid government-issued photo ID, and sign willingly and knowingly. The notary may refuse to notarize if these conditions are not met.
  • Once the notary has been sent out, the travel fee is non-refundable. That includes when the signing cannot take place because a signer is missing, has no valid ID, or the documents are not ready.
  • We do not prepare, explain or give advice about documents. A Florida notary who is not an attorney cannot give legal advice.

4.5 Loan signing agent

  • The signing fee (from $125) is per signing appointment and covers one visit to one location.
  • Once we have been sent to the signing, the fee is non-refundable if the signing is cancelled or does not go ahead, for example because a borrower does not appear, or the lender or title company changes or pulls the documents. A new appointment is a new order.
  • We present the documents as instructed by the lender or title company. We cannot explain loan terms or give legal or financial advice.

4.6 Wait time and stakeouts

  • Billed per hour (currently $80) with a 2-hour minimum. Time beyond the minimum is billed only as agreed with you in advance.
  • Wait time does not guarantee that the person will appear or be served.
  • Work has started once the server arrives on site. From then on the booked time is non-refundable.

4.7 Skip tracing and address verification

  • The fee is per person searched and pays for the search itself: basic trace (currently $75), advanced trace ($150) and address verification ($25).
  • Work has started once the search begins. From then on the fee is non-refundable, including when the search finds no new address. You still receive a written report of what was searched.
  • Results come from commercial databases and public records. We check them against more than one source, but we cannot guarantee they are accurate or current.
  • Service at an address the trace finds is a separate order and is billed separately. The exception is a locate-and-serve order, which includes service at one new address.
  • Permissible purpose: you confirm that you have a lawful, permissible purpose under the Driver's Privacy Protection Act and the Gramm-Leach-Bliley Act, such as service of process, litigation or collecting a valid judgment, and that you will use the results only for that purpose. Reports are not consumer reports under the Fair Credit Reporting Act and may not be used for decisions about credit, employment, insurance or housing. We may refuse any search.

4.8 Debt collection assistance

  • We serve legal documents in debt matters. We do not collect debts, demand payment, or contact debtors on your behalf, and we are not a collection agency.
  • These jobs follow the process service terms in section 4.1, including per-address fees.

4.9 Medical records retrieval

  • Quoted per request. Copy and certification fees charged by the provider are passed on at cost.
  • How long retrieval takes depends on the provider. We handle records in line with HIPAA and deliver them securely.
  • Work has started once the subpoena has been served or the request submitted to the provider. From then on the fee is non-refundable.

4.10 Process server websites

  • Each website project follows the written quote or agreement sent for it. Where that quote or agreement says nothing, these Terms apply.
  • The setup fee is non-refundable once design work has started. Domains, hosting and other third-party services are billed at the price quoted and are covered by those providers' own terms.

5. Your responsibilities

  • Give us accurate, complete information: the person's full name, the address, a description or photo if you have one, and any known schedule.
  • Send complete, correct and legible documents, with the number of copies needed, and make sure you have the right to have them served.
  • Order early enough for your deadlines. We are not responsible for a missed hearing or deadline caused by a late order, wrong information or incomplete documents.
  • We do not review documents for legal sufficiency. That is the job of you or your attorney.
  • Reply to our questions promptly. Delays in your reply may delay the job.

6. What we do not guarantee

We work diligently on every job, but we cannot guarantee that a person will be served or found, or that it will happen by a particular date. Some people avoid service, move, or cannot be reached. When that happens, you receive sworn returns and reports that document our work, and they can support a request to the court for another method of service.

7. We are not a law firm

Agera Legal Services is a certified process server, not a law firm, and none of our staff act as your attorney. Nothing on this website or in our emails, texts, reports or returns is legal advice. For legal advice, speak to a licensed attorney.

8. Communications and records

By ordering, you agree that we may contact you about your order by email, text message, phone and through the client portal. We keep records of our work, including timestamps, GPS locations and photographs. We use them to prepare affidavits and returns, answer questions about the work, and respond to payment disputes.

9. Limitation of liability

To the fullest extent the law allows, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses, such as lost claims, missed deadlines, lost profits or additional legal fees, except where the law does not allow this limit.

10. Governing law

These Terms are governed by the laws of the State of Florida. Any dispute will be resolved in the state courts located in Miami-Dade County, Florida.

11. Changes to these Terms

We may update these Terms from time to time. The version posted on this page on the day you place an order is the one that applies to that order.
