Subpoena service across Miami-Dade

Agera Legal Services is a Miami-Dade certified process server based in Kendall. Subpoenas are a regular part of our week: witness subpoenas for trial or hearing, deposition subpoenas, and subpoenas duces tecum that ask a person or a business to produce records. We serve them for law offices, for parties handling their own case, and for anyone else who has a subpoena that needs to reach the right person.

Our job is narrow and we keep it that way. The subpoena comes to us already issued and complete. We deliver it the way the law allows, document every attempt, and give you a sworn record of what happened. Whether a subpoena is the right tool, what it should ask for and when the witness must appear are questions for your attorney, not for us.

What we serve

  • Witness subpoenas for trial or a hearing, served on each person named.
  • Deposition subpoenas for a witness who is not a party to the case.
  • Subpoenas duces tecum for documents or records, served on the person who holds them.
  • Records subpoenas to businesses such as banks, clinics, employers and property managers, delivered to the records custodian or the person the business designates.
  • Related papers in the same case, such as a summons, at our regular levels.

Witnesses are served where they live or where they work. Businesses are served at their office or place of business in Miami-Dade, and we note the name and title of the person who accepted the papers.

How each subpoena is handled

Every attempt is logged in our field app at the door. The record holds the time, the GPS coordinates of the server and a photo of the address. Nothing is reconstructed from memory afterwards; the affidavit is written from that record.

Our servers try for personal delivery to the person named. For a records subpoena to a business, the server asks for the records custodian or the person in charge, and records who accepted the papers and in what role. When a subpoena names more than one witness, each person is served and documented separately.

Attempts are spread over different times of day. Every order includes up to 4 attempts at different times of day within your level's time, with a Saturday attempt when that time includes a Saturday. A witness who works days is often home in the evening; a business is easiest to reach in the middle of its working day, so the attempts are planned around that.

Witnesses in gated communities and condo towers are routine for us. Section 48.031(7) requires a gated residential community, including a condominium association, to grant unannounced entry to a person attempting to serve a resident, and our servers carry court-issued identification for the gate or the desk. If a building refuses anyway, the refusal goes on the attempt record. Read more about serving in gated communities and condo towers.

Timing: pick the level that fits your case

Every order is placed at one of four turnaround levels. Service days are Monday to Saturday, counted from when we have the paid order and the papers. Completed means served, or all included attempts made. Every level includes up to 4 attempts, the client portal, status updates, email confirmation and the affidavit.

The affidavit you receive

When the job is done you receive a notarized affidavit of service. It states who was served, the date and time, where, and how the service was made, in the form a Florida return of service takes under section 48.21. The photo and GPS record of each attempt are attached. If the witness cannot be served after the included attempts, you receive an affidavit of due diligence that documents each attempt instead.

The affidavit appears in your client portal the moment it is signed, together with the attempt log you followed as the job ran. Read more about what an affidavit of service is.

How to order

Order online in a few minutes: upload the subpoena, enter the witness or business name and the address, choose your level and pay. The order is confirmed by email, a server is assigned, and you can follow each attempt in the portal. Start your order, or call (786) 241-4146, Monday to Saturday.
