Divorce Papers Process Server in Miami

We serve divorce petitions and other family law papers across Miami-Dade, Monday through Saturday, quietly and professionally, with a GPS point and a photo on every attempt and a notarized affidavit when the job is done.

Family law papers, served with care

Agera Legal Services is a Miami-Dade certified process server based in Kendall. A good share of our work is family law: a petition for dissolution of marriage, papers about custody and time-sharing, child support papers, and the other documents that follow once a family case is open. We serve them for people handling their own case and for the attorneys who represent them.

These are hard papers to receive, and we treat every serve that way. Our servers are calm and brief, they do not discuss your case with the other party, and they do not hand papers to children. The goal is simple: the right person receives the papers, and you have a sworn record that shows it.

Our job stays narrow. You, or your attorney, prepare and file the papers. We deliver them and document every attempt. Questions about what to file, what to ask for or what happens next belong with a family law attorney.

Papers we serve

  • Petitions for dissolution of marriage with the summons and the papers filed with them.
  • Custody and time-sharing papers, including petitions to establish or change a parenting plan.
  • Child support and alimony papers, including petitions to establish or modify support.
  • Paternity papers served on each person named.
  • Injunction-related papers that a court or a party asks us to serve.
  • Subpoenas and other papers in a family case, at our regular levels.

We serve at homes, apartments and condo units across the county, and at a workplace when that is where the person can be reached. When the person is at work, our servers keep the delivery discreet.

How each family law serve is handled

Every attempt is logged in our field app at the door. The record holds the time, the GPS coordinates of the server and a photo of the address. Nothing is reconstructed from memory afterwards; the affidavit is written from that record.

Our servers deliver the papers to the person named, in person. You can add notes to the order, such as a description, a vehicle or the hours the person is usually home, and the server plans the attempts around them. If you share a home or a child with the person, tell us what to avoid and we will respect it.

Attempts are spread over different times of day. Every order includes up to 4 attempts at different times of day within your level's time, with a Saturday attempt when that time includes a Saturday.

Many Miami-Dade residents live behind a gate or in a condo tower. Section 48.031(7) requires a gated residential community, including a condominium association, to grant unannounced entry to a person attempting to serve a resident, and our servers carry court-issued identification for the gate or the desk. If a building refuses anyway, the refusal goes on the attempt record. Read more about serving in gated communities and condo towers.

Timing: pick the level that fits your case

Every order is placed at one of four turnaround levels. Service days are Monday to Saturday, counted from when we have the paid order and the papers. Completed means served, or all included attempts made. Every level includes up to 4 attempts, the client portal, status updates, email confirmation and the affidavit.

The affidavit you receive

When the job is done you receive a notarized affidavit of service. It states who was served, the date and time, where, and how the service was made, in the form a Florida return of service takes under section 48.21. The photo and GPS record of each attempt are attached. If the person cannot be served after the included attempts, you receive an affidavit of due diligence that documents each attempt instead.

The affidavit appears in your client portal the moment it is signed, so you can keep it with your papers or send it to your attorney. Read more about what an affidavit of service is.

How to order

Order online in a few minutes: upload the papers, enter the name of the person to be served and the address, add any notes for the server, choose your level and pay. Your order details stay between you and our office. The order is confirmed by email, a server is assigned, and you can follow each attempt in the portal. Start your order, or call (786) 241-4146, Monday to Saturday.

Divorce papers questions

How much does it cost to serve divorce papers in Miami?

Family law service is priced by turnaround level: Standard $60, Rush $80, Same Day $100 and Same Day + $200. Every level includes up to 4 attempts, the GPS and photo record, status updates and the notarized affidavit.

Which family law papers do you serve?

Petitions for dissolution of marriage, custody and time-sharing papers, child support and alimony papers, paternity papers, injunction-related papers and subpoenas in a family case. You give us the papers; we do not prepare them.

Will the server talk to my spouse about the case?

No. The server identifies the person, delivers the papers and leaves. Our servers do not discuss the case or the papers with anyone.

Can you serve my spouse at work?

Yes, when that is where the person can be reached. The server keeps the delivery brief and discreet and records where and when it happened.

How fast can divorce papers be served?

It depends on the level you order. Standard makes the first attempt within 72 hours, Rush within 24 hours, Same Day the same day, and Same Day + makes more than one attempt the same day. Service days are Monday to Saturday.

What do I get back after the papers are served?

A notarized affidavit of service stating who was served and how, when and where, with the photo and GPS record of each attempt. It appears in your client portal as soon as it is signed.

Do you give legal advice about divorce or custody?

No. Agera Legal Services is a certified process server, not a law firm. We serve and document the papers you send. For what to file or what to ask for, talk to a family law attorney.
